Request for Public Records
Legacy Academy is a public entity and its records shall be matters of public information subject to such restrictions as are set by federal law or regulation, by state statute, or by pertinent court rulings.
In accordance with the Colorado Open Records Act (CORA), Legacy Academy will assist with all requests for public records. In order to be considered a public record, it must be maintained by the school.
Legacy Academy shall make every effort to respond within three working days, as provided by § 24-72-203(3)(b), C.R.S. This three-day period begins on the first working day following receipt of the request.
The following is an example of a response timeline assuming that there are no holidays:
- If a request is received before 4:30 p.m. on Tuesday, the three-day period would begin at 8 a.m. on Wednesday and end at 5 p.m. on Friday.
- If a request is received after 4:30 p.m. on Tuesday, the three-day period would begin at 8 a.m. on Thursday and end at 5 p.m. on the following Monday.
Sometimes an extension is necessary if the requested information will take longer than three days to complete. In this case, the requestor would be notified of the request for an extension. Legacy Academy may extend its response period up to seven working days if it finds extenuating circumstances exist and communicates that finding to the requestor in writing, as described in § 24-72-203(3)(b), C.R.S. The extension period would begin on the fourth working day following receipt of the request.
If citizens wish to view the public records without receiving a copy, there is no charge. There will be a $.25 per page charge for copying records unless the record is available electronically. Please keep in mind not all records are available electronically. In addition, charges will be added for the cost of processing the request at a rate of $41.37, as allowed by statute.
If a records request requires more than mere retrieval of records—such as technical expertise to synthesize or reconfigure data—Legacy Academy will charge the requestor for such costs, in accordance with the guidelines below. Any costs charged to a requestor shall not exceed the actual cost of producing the records, in accordance with § 24-72-205(5)(a), C.R.S. A different fee structure applies if the records requested are subject to the Colorado Criminal Justice Records Act (CCJRA).
Prior to producing requested records, Legacy Academy will provide an estimate of the costs of production to the requestor. The requestor must approve the cost estimate and provide an advance deposit of the expected cost before Legacy will begin work on fulfilling the records request. The timeframe for Legacy to complete the request will begin once the requestor has approved the cost estimate and submitted the initial deposit.
After a requestor has agreed to the costs of production and paid the initial deposit, Legacy Academy will keep the requestor informed if any additional costs are anticipated and will not incur any additional costs without the requestor's prior consent. After compiling the requested records, Legacy Academy will provide a final invoice to the requestor. Costs must be paid in full before Legacy Academy provides the records unless alternative arrangements have been made. The requester may proceed by paying the estimated cost, by cash or check, at the front office (Legacy Academy does not have an online payment option). Upon payment, the request will be processed. In the event that the cost to fulfill the request is less than the initial deposit, any leftover funds shall be reimbursed to the requestor.
Some records are not open for public inspection, including student records and portions of personnel files. For student records, please contact your child’s school. Confidentiality of academic records is protected by the Family Educational Rights and Privacy Act (FERPA) and not subject to CORA.
